1. Who we are and what these terms cover

These Terms of Service (“Terms”) are published by Surf Digital Limited (“Surf Digital”, “we”, “us”), a company based in Auckland, New Zealand. They apply to your use of surf-digital.com (the “Website”) and to the cold email and LinkedIn outreach services described below (the “Services”).

When you apply for or purchase a Service, you will also sign a package-specific Service Agreement with Surf Digital. Where a signed Service Agreement exists for your engagement, its terms are the governing contract between you and Surf Digital for that engagement. These Terms are a plain-English summary intended to sit alongside that agreement, describe our current commercial terms to website visitors and prospective clients, and apply on their own where no separate signed agreement exists (for example, for general use of the Website). If there is a direct conflict between these Terms and your signed Service Agreement, your signed Service Agreement controls for your engagement.

2. Services we offer

Surf Digital currently offers four engagements. Full scope details are confirmed in your Service Agreement.

Sprint ProA managed multichannel outbound campaign combining cold email and LinkedIn, targeting up to 45 ICP-fit meetings across the engagement and up to 22,500 prospects. Includes unlimited industries and retargeting campaigns. You (the client) respond to and manage leads generated by the campaign; Surf Digital does not provide managed reply or follow-up handling under this package.$7,500 AUD upfront90-day engagement, 90-day minimum commitment
Agency Outreach SystemA managed multi-channel outreach campaign combining cold email and LinkedIn. Surf Digital manages lead replies, follow-ups, and appointment booking, targeting up to 60 ICP-fit meetings across the engagement and up to 30,000 prospects.$8,000 AUD upfront90-day engagement, 90-day minimum commitment

Where our Website or team describe a number of meetings, replies, or other outcomes for a package, that figure is a target, not a guarantee — see Section 6.

3. Payment terms and currency

The Free Campaign infrastructure fee is billed in USD. The Sprint, Sprint Pro, and Agency Outreach System fees are billed in AUD. The exact amount, currency, and due date for your engagement are set out on your invoice and Service Agreement.

  • The Sprint, Sprint Pro, and Agency Outreach System fees are paid as a single upfront payment before the 90-day engagement begins, and cover Surf Digital's full delivery of services for that engagement.
  • Invoices are generally payable via Wise or Stripe, as specified on the invoice, within 3 days of the invoice being issued.
  • The Free Campaign infrastructure fee covers the direct third-party cost of the domains and inboxes used to run your campaign. It is confirmed with you and must be paid before that infrastructure is purchased or activated on your behalf.
  • If payment is more than 7 days overdue, we may temporarily pause the affected Service until payment is received.

4. Cancellation and refunds

Our cancellation and refund terms differ by package, reflecting the fact that the Free Campaign has no agency fee and no lock-in, while the Sprint, Sprint Pro, and Agency Outreach System are fixed 90-day engagements paid upfront.

Free Campaign

  • There is no lock-in period. Either you or Surf Digital may end the free campaign at any time, for any reason, with no cancellation fee.
  • The $85 USD infrastructure fee covers a direct, pass-through third-party cost (domain and inbox purchases). Once this infrastructure has been purchased or activated on your behalf, the fee is not refundable, because Surf Digital has already incurred that cost with the relevant third-party provider on your behalf.
  • Because no agency, strategy, sourcing, or copywriting fee is charged for the Free Campaign, there is no service fee component to refund.

Surf Digital Sprint, Sprint Pro and Agency Outreach System

  • All three packages require a 90-day minimum commitment. The engagement cannot be cancelled by either party during that first 90 days.
  • The upfront fee is paid before work begins and covers Surf Digital's committed delivery of the full 90-day engagement. As it covers services that are rendered progressively over the engagement, the upfront fee is not refundable once the engagement has commenced, including if you decide to stop using the Service before the 90 days are complete.
  • After the initial 90-day period, either party may terminate the engagement by giving 14 days' written notice. No further fee is due for time after termination takes effect, and no refund is owed for services already delivered.
  • Late or non-payment does not itself cancel the engagement; it may result in a temporary pause in services until payment is received, as described in Section 3.

How to request a cancellation or refund

To cancel a Service, end a Free Campaign, or ask about a refund, email us at thomas@surf-digital.co with your name, company name, and the package you signed up for. We will confirm receipt and, where a cancellation right or refund applies under this Section 4, confirm the outcome and any applicable timing in writing.

5. Service commencement and delivery timeframes

Work begins once we have received your signed Service Agreement, the onboarding information needed to build your campaign (offer details, target market, sender and sending details, and any required approvals), and, where applicable, cleared payment.

  • Campaign setup includes lead sourcing, copywriting, domain and inbox setup, and DNS and sending infrastructure configuration. Because new sending domains and inboxes need to be warmed up before high-volume sending begins, there is typically a short setup and warm-up period between onboarding and full campaign send volume.
  • The Free Campaign runs for 1 month from its launch date.
  • The Sprint, Sprint Pro, and Agency Outreach System run for a 90-day engagement from campaign commencement, as described in your Service Agreement.

6. Campaign targets are not guaranteed results

Where we describe a target number of meetings, replies, conversions, or other outcomes (for example, a target of up to 5 ICP-fit meetings on the Free Campaign, up to 30 on Sprint, up to 45 on Sprint Pro, or up to 60 on the Agency Outreach System), that figure is a target only. We use reasonable efforts, our processes, and our experience to work toward these targets, but we do not guarantee a specific number of meetings, replies, conversions, sales, or revenue for any package.

Outcomes depend on factors outside our control, including market conditions, your offer and pricing, your responsiveness and feedback, data quality, deliverability, and prospect availability.

Do you guarantee results?

We're highly selective about the businesses we work with. Before taking on a client, we assess their offer, audience, and market to make sure outbound is likely to be a strong fit — but even with that screening, no agency can responsibly guarantee exact results. As above, campaign performance can be affected by factors outside our control, including market demand, competition, regulatory changes, and broader economic conditions.

What we can promise is a rigorous, hands-on approach. We combine proven outreach strategies, professional infrastructure, ongoing testing, and continuous optimisation to give every campaign the strongest possible chance of success.

Our work has produced strong outcomes across marketing, software, recruitment, training, real estate, and professional services — you can explore our case studies to see the results for yourself. If we choose to work together, it's because we genuinely believe we can create meaningful results for your business.

7. Client responsibilities and approvals

To help us deliver your campaign, you agree to:

  • Provide accurate company information, target audience details, messaging guidelines, and any sales assets or proof points we reasonably need to build your campaign.
  • Give timely feedback on campaign messaging, targeting, and performance so we can optimise the campaign.
  • On the Sprint and Sprint Pro packages, respond to and manage the leads the campaign generates — Surf Digital does not manage replies, follow-ups, or close sales under these packages.
  • On Sprint Pro and the Agency Outreach System, provide LinkedIn sender access or assets where the campaign requires it.
  • On the Agency Outreach System, attend, reschedule, or otherwise manage meetings once we have booked and handed them over to you.
  • Ensure your business and its use of the Services comply with email marketing and, where applicable, LinkedIn platform rules relevant to your industry (for example, anti-spam and privacy laws such as the Spam Act, CAN-SPAM, and GDPR where they apply to you).
  • Tell us promptly about any changes to your business, offer, or target market that affect an active campaign.

8. Intellectual property

Surf Digital's outreach strategies, campaign frameworks, email and LinkedIn copy templates, and methodologies remain the exclusive property of Surf Digital. You may not disclose, share, resell, or use them for your own separate business or for the benefit of another business.

You may use the leads generated by your campaign for your own business purposes, but you may not resell or transfer those leads to third parties.

Both parties will keep confidential any business, marketing, or operational information shared during the engagement, and will not disclose it to third parties without prior written consent, except as needed to deliver the Services or as required by law.

You grant Surf Digital the right to identify you as a customer and to reference your name, logo, and publicly available brand assets, and to publish case studies or performance results describing the Services delivered to you, without disclosing your confidential information. If you reasonably ask us to exclude specific confidential or commercially sensitive details, we will make reasonable efforts to accommodate that request.

9. Non-solicitation

You agree not to hire or solicit Surf Digital's employees or subcontractors during your engagement and for 6 months after it ends, and not to use Surf Digital's outreach strategies for your own clients or share them with competitors.

10. Liability

Surf Digital operates as an independent service provider, not as your employee or agent. We are not responsible for the financial, reputational, or legal consequences of the outreach campaigns we run on your behalf, or for how you use the leads or meetings generated. You remain responsible for ensuring your use of the Services complies with laws and platform rules that apply to your business.

Nothing in these Terms is intended to exclude any right you have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 (NZ) that cannot lawfully be excluded.

11. Governing law

These Terms, and any Service Agreement entered into with Surf Digital, are governed by the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the courts of New Zealand.

12. Changes to these terms

We may update these Terms from time to time, for example to reflect a new package or a change in our processes. We will update the "Last updated" date above when we do. Changes will not apply retroactively to reduce rights you already have under a signed Service Agreement.
